Terms of the Service (Last updated on the 20 August 2012)

The English version of this document has been translated for your information and with the aim of giving users a better service. Should there be any translation mistakes or contradictions the Italian version of this document will be the sole document representing iShopps for its Terms of Service.

This document establishes the “Terms and Conditions for the iShopps Service”, hereafter known as “Terms of Service”. They regulate the users’ access and use of the service, by means of the access and the use of “iShopps”. Please read this document extremely carefully and contact us via email at info@ishopps.com should you have any questions or doubts. By accessing and/or using the iShopps Services, you are agreeing to accept the following Terms of the Service and the Privacy Policy. The Terms of the Service are applicable to all the users, whether they be registered or simply visitors. Under no circumstances whatsoever may you use the App service without having read, acknowledged and accepted these Terms of Service.

When you decide to use iShopps you are agreeing to the following conditions:

1. You must be thirteen or over to use the iShopps application.
2. Breaching any of the points of this agreement leads to the automatic termination of your iShopps account. We strongly advise you to use the application correctly, and under no circumstances whatsoever do we take responsibility for any of the content submitted or posted. You must be aware that should you decide to use iShopps, you do so at your risk, even that of being exposed to content that is offensive, indecent, innacurate, arguable, or in any other way inappropriate.
3. Please remember that when using the iShopps Service, you cannot in any way whatsoever breach any of the laws applicable in the country where the Service is being used.
4. Posting nudity, whether it be total or partial, or sexually explicit photographs is strictly forbidden.
5. It is strictly forbidden to post images or contents regarding specific categories of goods: sexy shops, arms and ammunition, hunting and fishing, funeral parlours, liqueurs and spirits, tobacco and cigarettes, betting and lotteries, astrologers and fortune tellers.
6. You must not abuse, molest, threaten, imitate or intimidate the other iShopps users. Furthermore it is forbidden to post content that may damage the correct functioning of the Service.
7. Under no circumstances may you use the iShopps service for any illegal or unauthorized purposes. International users agree to operate and publish contents in compliance with these Terms of Service. iShopps holds you solely responsible for your conduct, and any information, text, data, screen names, graphics, photos, profiles, audio and video content and links that you post or share on the iShopps service. It is strictly forbidden to modify or carry out any action that can damage the correct functioning of the web site and the iShopps application. Moreover an inappropriate and/or unauthorized use of the iShopps brand, site and/or Service is not allowed.
8. It is forbidden to use the Identity of another user (i.e. using the identity of a celebrity or of a retailer), creating or using an account for another person, giving an e-mail address which is not your e-mail address or creating more accounts.
9. You are solely responsible for any activity carried out in your name, and in no case can it be considered that user contents can be sponsored or sustained by iShopps.
10. Keeping your password safe is entirely your responsibility.
11. It is strictly forbidden to send emails or messages, inappropriate comments and comments with the intent to advertise using the Service (Spam).
12. It is absolutely forbidden to use the URL code and the iShopps web site in your name.
13. It is forbidden to post images from stores, brand-stores and shopping centres that do not authorise photography and recording on their premises. iShopps declines all responsibility arising from the non- compliance with these norms.

Your contents. iShopps allows you to post contents, comments, ashtags, likes, photos and videos on the Service. By deciding to share, display or in any way make available content on the Service (hereafter known as “User Content”), you are giving iShopps the right to use that content.

Categories of goods. iShopps grants the permission to publish the images of the goods sold by the stores all over the world. However, there are restrictions regarding the categories of goods that can be displayed, inserted and documented within the application. In particular it is forbidden to display images, contents, information, promotions and anything that refers, whether it be directly or indirectly, to the following categories of goods: sexy shops, arms and ammunition, hunting and fishing, funeral parlours, liqueurs and spirits, tobacco and cigarettes, betting and lotteries, astrologers and fortune tellers. iShopps reserves the absolute right to automatically cancel from the data base, without prior notice, the user and retailer accounts that violate this norm.

Prohibition regarding photography and filming. iShopps encourages and supports shops, brand-stores and shopping centres that make it possible to share the images of the products on sale by means of the app, convinced that the best way to advertise is via the customers themselves, who, thanks to their network of contacts and friends, can spread the knowledge of the products and the offers, increasing the audience and bringing a higher number of purchasers to the retail outlets. However, there are a great many shops, brand-stores and shopping centres in the world that do not allow filming and photography on their premises. Therefore we urge iShopps users to check if it is forbidden to photograph or film before sharing the images via the application. iShopps declines all responsibility arising from the non-compliance of these norms.

Restrictions regarding the display of user content. iShopps allows users to share pictures and/or short videos (max. 15 seconds) dividing them into three categories: “love”, “gift” and “bought”.

In the category “love” you can share not only those products you would like to get, but also those you like or think can be interesting and suitable for other users. You can also share the shopping streets, amazing shopping windows, stores’ ambient and the original points of view of the visited stores, the signs, brands, packages and anything else that may be of interest in the shopping world.

In the category “gift” you can share products you have bought (or you wish to buy) in order to buy a gift for someone. It is always nice to get a present for other people, thinking about the pleasure and surprise of the person who is going to receive it. But it is even better and more useful to share these moments with your friends, you can ask them for advice and suggestions when you are not sure what to get!

The “bought” category is dedicated to purchased products. It is always a good feeling to spend a little time wandering round the stores, looking for something perfect and buying yourself something. Sharing this pleasure with other people in real time is more gratifying because every feeling in the world is better when it's shared.

Using any of these three categories, user can also point out: price, a short comment, tags (key words that allow the research), store name and its geo-localization. User can also decide to share its item on Facebook or to keep that private, using the “Private only” tap (lock icon). iShopps allows private users to post an unlimited amount of images and content in the application. However, any attempt to abuse or damage the Service using excessive uploading activities will be blocked and the account involved may be terminated from the iShopps database without any prior notice.

Private users points. Any time you use iShopps with a Private user account (not retailer) you can get more points in order to reach a new level of popularity in the community. There are five user statuses:

“star” over 50.000 points
“celebrity” from 20.000 to 49.999 points
“expert” from 5.000 to 19.999 points
“qualified” from 1.000 to 4.999 points
“beginner” up to 999 points

Increasing the amount of your points and your popularity in iShopps is amusing and easy, you only have to share your enjoyable shopping experiences using the app. Moreover you can get points and reach new levels by other actions (as becoming “Follower” of users and stores) that allow you to get points in different quantities. Here is a list of actions that can give you points:

other user registration (when a user registers with your ID e-mail)

add store (when you add the name of a store)

follower (followed by users or a retailer)

fan (becoming a fan of a retailer)
love brands (add a brand to the personal list)
invite a friend (sending an e-mail invitation)

photo/video “like” on other user item

Once you reach the maximum amount of points for each status you will automatically reach the next level. For every status change in your user profile, the status icon, photo frame and background picture will also change. Your information will be showed in a new visual context that will underline the experience level reached. So, with a little commitment and a lot of enjoyment you can quickly become an important person in the iShopps community and gain visibility in the section “Popular”.

In order to maintain or increase your popularity level you have to use the app with continuity. If iShopps is not used for more than 30 days, you will day by day lose the points you have gained previously, and also get back to the previous status, to the beginner level with the amount of points you were given on registration.

So every time you shop remember to share the amazing things you find in order to increase your popularity level.

Warning! Remember that registering fake users or retailers just to get more points will end in a cancellation of the account without any notification.

Restrictions regarding the display of retailer content. iShopps allows retailers to display photographs and/or short recordings (maximum 15 seconds), ranking them in three categories: “store”, “product” and “on offer”.

In the “store” category it is possible to post pictures or videos of the store (shop windows, environments, store areas, etc.), for each picture the retailer can write a short comment and add tags (key words for the research).

In the “product” category it is possible to post pictures and videos of the selling products, for each picture retailer can write a short comment and add price in local currency (that can be selected in the “Settings” area), tags (key words for the research).

In the category “on offer” it is possible to post pictures and videos on offer, for each picture the retailer can write a short comment, the old price and the new price in local currency (the App will calculate automatically the percentage of discount), date of ending of the offer and tags (key words for the research).

For any category selected, the retailer can decided to share that item on Facebook.

Pictures display is currently authorized according to the following numerical restrictions:
- in the “store” category it is possible to display up to a maximum of 9 (nine) images
- in the “product” category it is possible to display up to a maximum of 18 (eighteen) images
- in the “on offer” category it is possible to display up to a maximum of 9 (nine) images.

Retailers must delete photos that have already been posted if they wish to upload new ones if they have reached the maximum number of posts allowed.

The new images uploaded in the category “on offer” must be accompanies by the expiry date of the offer established by the retailer during the upload. This expiry date cannot be more than 365 days. Once this established date has expired, the sentence “offer expired” will appear under the image, istead of the expiry date itself. However the image will remain visible for the iShopps users until the retailer decides to delete it.

The future versions of the application will enable the limit of the number of images that can be displayed by each retailer to be exceeded, by means of the acquisition of “credits” that will make it possible to manage the “pay per day” communication campaign autonomously.

How iShopps and the other Users can use your contents. Independently of the setting of your account you decide to use, you are granting iShopps the non-exclusive right to use, show, reproduce, re-share, modify (re-format, for example) and distribute your User Content on the iShopps Service or on others it may have, with the aim of operating and guaranteeing the Service to you and the other users. The right to do so is completely royalty-free, transferrable and sub-licensable and valid worldwide. You must remember that the iShopps Service is a public platform, and that other users can search for, see, use and/or share any User Content that you decide to make public via the Service.

Keeping user contents. For any termination of the Service or deactivation of your Account, or if you remove any user content from your account or from the Service, we inform you that iShopps reserves the right to retain your user content for backup, archival, or audit purposes. Moreover you should remember that other users may retain and continue to show, reproduce, re-share, modify, re-position and distribute any of your User Content that other Users have marked as “non-active”. All the data that the user has uploaded will be available in our archives. Thanks to this a user will always have the chance to “return”, having their account re-activated. If someone is looking for a user profile that is “not active”, a message will appear saying that the user is no longer in the data base (and therefore the data will not be visible). The user’s name will no longer be visible in the comments.

Your responsibilities regarding the User Content. iShopps was born with the objective of forming a creative and positive community that would allow you to discover and share your shopping experiences if you are a user, or allowing others to get to know your products and offers if you are a retailer.

Please remember that you may be prosecuted in the case where, for example, the content of your material proves to be false, intentionally misleading or libellous, or should it violate in any way whatsoever the right of any third party, copyright, brand, patent, trade secrets, moral rights, right to privacy, advertising or any other right regarding intellectual property or ownership, or in the case where it illustrates unlawful material, including unlawful discourse or incitement to hatred or pornography, or should it harm in any other way whatsoever minors, or if it is in breach any law or regulation or incites others to violate them.

User content does not represent or express any opinion of iShopps. We reserve the right, but not the obligation, to remove the User Content that we consider to be in breach of the Terms of Service for any reason whatsoever. Therefore we ask you to continue to enjoy our fantastic App, using it as appropriately as possible and in respect of the other Users. We shall remove User content if we are specifically asked to do so by the person via an email at info@ishopps.com.

For Third Parties. iShopps respects the rights of Third Parties, creators and owners of the content and we ask you to do the same. Moreover you agree that any User Content you share or post on the Service does not, and shall not breach any existing law or infringe the rights of any third party, including without restriction all intellectual property (defined hereafter), advertising or right to privacy. iShopps considers it to be essential that you understand that you are in the best possible situation to know for sure if it is possible to share your User Content. We also ask you to proceed with caution when you decide to make your User Content public on the Service.

Definition of Intellectual Property Rights. When we refer to intellectual property rights in these Terms of Service we are referring to any patent, copyright, moral right, advertising right, registered trademark, brand (and associated goods);trade secret rights and any other existing intellectual property or that will hereafter come into existence, regulated by the laws of any state, country, territory or jurisdiction.

The feedback you give us. iShopps is interested in its Users, and in discovering how we can improve the Services we offer. So we would really appreciate it if you could let us know what you think, your suggestions and advice. However we must remind you that any material we receive from users will not be paid for in any way whatsoever by iShopps. iShopps will not provide any form of compensation or remuneration to users for the abovementioned material received. Users must be aware of the fact that any suggestion, advice, information and/or content sent to iShopps may be freely used by iShopps at our complete discretion.

Property of iShopps contents. Except for the User Content published on the Service, all the contents and other material present on or in the Service, and all the intellectual property rights present in or in relation to the Service or any other form of content are the exclusive property of iShopps and its licensees, including, but not limited to, the visual interfaces, interactive functions, graphics, design, compilation, code of application, products, software, the ranking of aggregated user reviews and third party content. We are also the owners of the copyrights, trademarks, service brands and other intellectual and ownership rights all over the world associated to iShopps, which are protected by the laws regarding copyright, trade dress, patents, trademarks and any other applicable laws on intellectual property and ownership. Therefore it is strictly forbidden to alter, reproduce, distribute, create derivative works or adaptations, show in public or in any other way exploit, whether it be partially or wholly, any of the content on iShopps, unless previously authorised by us. Apart from what is specifically regulated by these Terms of Service, you agree not to use, modify, reproduce, distribute, sell, licence or exploit the contents of iShopps in any way whatsoever, without our prior consent.

Our licence for you. Subject to the Terms of Service, and the conditions of the service terms and our Privacy Policy, we guarantee you the licence to use the Service, including the possibility to access and see the iShopps content for personal purposes, not commercial ones, and to share what you like, what you are thinking and your shopping habits in general. iShopps reserves the right to be able to terminate this licence at any time whatsoever, for any reason whatsoever or even in the absence of particular reasons. Except for this guarantee, all the other rights are the exclusive property of iShopps and no other right can be reserved to the users by means of other licences.

The Users who can use the Service. You can only use the Service if you are able to establish a contract with iShopps and only if you are in agreement with what is stipulated by the Terms of Service and is applicable by laws, regulations, and local, state, national and international rules. Any access or use of the Service by someone who is not 13 or over is strictly forbidden. As we respect the iShopps community, the Service will not be available for those who are excluded from the use of the Service.

iShopps Accounts. Creating an Account with iShopps allows you to access the Service solely at our discretion. We may keep several types of Accounts for different types of Users (private, shops and brands). Should you decide to open an Account, registering in the name of a company, organization or any other kind of entity, then the “you” shall refer to yourself and the entity you represent, and you guarantee that you are the authorized representative of that entity with the power to represent it in the Terms of Service, and that you accept the following Terms of Service on behalf of the entity. By linking iShopps to a third party service (for example Facebook), you are authorizing iShopps to access and use your information from that service and to keep your credentials to access that service. For further information regarding the type of information that we get form third party services, please read our Privacy Policy. You accept not to use user names that are deemed offensive, obscene or abusive towards other users. iShopps reserves the right to ask you to change name at any time or for whatever reason, even for no reason whatsoever, at the sole discretion of iShopps.

Terminating your account. You are able to terminate your account at any time, sending an email to info@ishopps.com. Ishopps can terminate your account permanently or temporarily or suspend your User Account or access to the Service for any reason whatsoever, without having to give you prior notice or information, including whether we deem, at our sole discretion, that you have breached any of the Terms of Service or the Privacy Policy or even for no reason whatsoever. Even if your account has been terminated, you will still be subject to the following Terms of Service, for all the sections described within the Terms of Service regarding the use and maintenance of the user content, the feedback you have provided us with, the definition of intellectual property, iShopps content, copyright policy, closure of the account and interaction with other users.

Your responsibility for your account. When you create an iShopps account you are obliged to provide precise and complete information. Please make sure you provide us with updated data, so that we know how you can be contacted. iShopps advises its users to create passwords that are difficult to reproduce, combining several elements of capital letters, small case letters and numbers for your account. Please remember that you are solely responsible for everything that happens to your account and that you agree to keep your account, login and password details safe. Please inform iShopps immediately of any violation that takes place regarding the security of your profile.

Changes to the service. iShopps reserves the right to change the settings, carry out modifications and changes to the Service without the obligation to give Users any prior notice or information on the matter. Therefore we recommend you check the Terms of Service regularly so that you are always up to date regarding the changes made.

Relationships with other Users. Please remember that you are solely responsible for your interaction with other users. We reserve the right, but not the obligation, to control and monitor on-going disputes between the other users. iShopps shall not be in any way responsible for your interaction with other Users or for any other action carried out by another user.

Privacy and security. We strongly recommend you to read the Privacy Policy to safeguard your privacy and security. You will find the Privacy Policy on the web site . In any case, please remember that you are using the Service at your risk.

Links to third parties, web sites and Services. The service may contain Contents such as links to third party web sites, advertising, Services, special offers or other events and activities that are neither the property of iShopps nor controlled by iShopps. Therefore iShopps cannot be in any way whatsoever held responsible for any content coming from a third party such as: sites, information, material, products or Services. Furthermore, iShopps is in no way responsible for any content, activity, information, product, promotional material, published by users that in any way causes damage to others. If you access content, a site, link or any other form of link to a third party, you are doing so at your own risk, and automatically agree that iShopps is not responsible in any way for any consequence that may arise from the said links to third parties.

iShopps updates. Our aim is to create an App that is dedicated to making your shopping experience a unique one via your iPhone. iShopps grants you a non-exclusive and non transferrable licence that can be revoked at any time and for any reason whatsoever and for no reason whatsoever to use the App from your mobile phone. It is strictly forbidden to modify, disassemble, decompile or reverse engineer the App. It is equally forbidden to lease, lend, receive on loan, resell, sub-licence, distribute or in any way transfer the App to any other third party or in any way use the App to provide time sharing or services of this type to any other third party. It is also equally forbidden to make copies of the App, remove, disable or damage, change or in any way interfere with the features connected to App security, features that prevent or restrict the use and copy of any content that is accessible via the App, or features that strengthen restrictions regarding the use of the App, as well as cancelling the copyright and rights of other owners on the App. You must be aware of the fact that iShopps can, at any time, issue upgraded versions and automatically upgrade the App version you are using on your mobile. You agree to these upgrades via your device, and agree that the Terms of Service and the Privacy Policy shall be applied to these upgrades. Any third party code that can be included and incorporated in the updating of the App is covered by the applicable open source or third-party end user license agreement, if any, authorizing the use of such a code. This license does not represent a sale of the App or any copy thereof, and iShopps retains (as do any third party licensors or suppliers) all right, title, and interest in and for the App (and any copy of it). You agree to comply with all the European and global laws related to use of the App and the mobile services.

Costs. The App is sold free of charge at the Apple Store, and the costs regulated by the telephone company will be applied.

Information for advertisers. In future there will be the opportunity to insert advertising, so please keep in touch, and have a look at the “Business” page on our website.

Apple. Even though the App is sold at the Apple Store, you agree and acknowledge that Apple is in no way responsible, and cannot in any way be held responsible, for any interaction between you and iShopps.

Indemnity. You agree and are aware of the fact that you indemnify and hold harmless iShopps and its executives, managers, employees and agents of any demands, suits, claims, proceedings, disputes, liabilities, damage, losses, costs and expenses, including, and without limitation, reasonable legal and judicial fees (including costs of the defense of claims, suits or proceedings brought by third parties), arising from any person in any way related to your access to the Service or to the contents of iShopps, your user content or any breach you may be in regarding any of these Terms of Service.

Disclaimer. The Service, including without limitation any kind of content included in the application, are provided on an "as is" and “as available” basis, without any kind of guarantee, either explicit or implicit. Also in future iShopps categorically disclaims any guarantee regarding the reliability of the service. iShopps takes no responsibility whatsoever for any user content that you or any other user or third party posts or sends to the service. You are solely responsible for your User Content and the consequences arising form your posts or from the material that is shared and published. Moreover you agree that we are only acting as a passive conduit for the online distribution of your content and that of other users on and via the Service. You are aware of and agree that you may be exposed to content that may be deemed offensive, harmful, damaging, disturbing and violent, or can in any way be deemed objectionable or incorrect, misleading, dubious, false, inappropriate for children, or otherwise unsuited to your purpose.

Limitation of Liability. You are aware of and agree that, to the maximum extent permitted by the law, the entire risk arising from your access and use of the Service is yours, and that you use the service at your risk. You agree to renounce any claim, suit, case or judicial proceedings against iShopps and its collaborators. You agree that neither iShopps nor any other party of any kind involved in the creation, production or delivery of the services will be liable for any incidental, special, exemplary, punitive or consequential damages, including lost profits, loss of data or loss of goods, the interruption of the service, computer damage or system failure or the cost of substitute products or services, arising from these Terms or the Service, or from the use, or inability to use the Service, user content, iShops contents or any other communication, interaction or real or virtual meeting with other users and non-users, or persons with whom you have interacted via the Service system, or as a result of using the service. iShopps is in no way whatsoever to be held responsible for any problems which may arise regarding users and retailers relative to the development of the use of the said Services. The limitations of liability set forth above are the fundamental elements at the basis of the agreement between you and iShopps. Some jurisdictions do not allow the exclusion of certain guarantees or the exclusion or limitation of liability for consequential or incidental damages, therefore the disclaimer stated above and the limitations may not be applicable to you.

In any case the maximum amount that is reimbursable by iShopps for any kind of penalty deriving from any different jurisdiction cannot exceed for any reason whatsoever the sum of 100 Euros (one hundred Euros). The Service is monitored and operates from its offices in Italy. iShopps does not guarantee, nor does it take the responsibility for declaring that its product is available in other countries. All those who gain access or use the Service in areas with jurisdictions that are different from Italy do so under their own responsibility and free will, and are entirely liable, solely and totally, for compliance with laws, statues, regulations, regional, state, federal, constitutional and directive laws, and any other legal interpretation of Governments, regulatory authorities or competent courts, including, but not limited to, regulations regarding the import or export of software, technical information and Services. It is possible that you will not be able to use the Service if you reside in a country that is currently embargoed by Europe or if you are a foreign person or entity that has been blocked by Europe or deemed unwelcome.

Arbitration and Governing laws. For any on-going dispute with iShopps, you agree to contact us first at info@ishopps.com and attempt to resolve the dispute with us in an informal way. In the unlikely event that iShopps is unable to resolve the dispute with you in an informal way, we agree to resolve the dispute, claim, related or deriving from the use of the Service or in relation to the terms of Service, or breaches or presumed infringements, through the competent Court of arbitration of Turin, (Italy). This court is deemed to be the sole and only court to formally resolve this type of dispute. By agreeing to these Terms of Service, you and iShopps waive the right to take part in any class action activity. You also agree that the service may be judged solely and entirely in Italy , and any ensuing disputes that may arise will be considered null and void, that is to say that do not give rise to judicial actions, whether they be specific or general, in jurisdictions that are different from that of Turin (Italy). These Terms are regulated by Italian Law, without taking into consideration the conflict of the principles of law. The application of the United Nations Convention on contracts for the international sale of goods is expressly excluded. Both parties agree to submit to the jurisdiction of the Court of Turin (Italy), for any actions for which either party retains the right to seek injunctive or any other equitable relief, as described further in the previous articles.

Notification Procedures and changes to the Service. iShopps may send notifications, whether they be required by the law or for marketing or any other purposes, to you via email “pushes” or may send notifications via mobile devices, or by posting them on the web site, as established by iShopps and at the sole discretion of iShopps. iShopps also reserves the right to establish the form, timing and contents of the notifications, bearing in mind that you can decide not to receive these notifications. Following access and the use of the Service, you waive the right to make any claim regarding the fact that you have not received notifications. iShopps may decide at any time, and for any reason whatsoever, or for no reason whatsoever, to change the text of this document or any other document regarding the terms of the Service. Therefore we recommend that you read the pages regarding the Terms of Service regularly.

Assignment. These Terms of Service and any other right or licence granted hereinafter, cannot be transferred nor assigned by you, but can be assigned by iShopps without any restriction whatsoever. Any attempt to transfer or assign them is deemed to be in breach of this agreement and therefore shall be deemed null and void.

Export control. Any software or technology obtained by iShopps through the Service, including App, originates in Italy, and is subject to Italian laws regarding exportation. It is possible that this type of software and technology may not be exported or re-exported to certain countries or used by persons who are not allowed to receive material exported from Italy. Furthermore, software and technology obtained from iShopps may be subject to the import and export laws of other countries. Using this application, you agree to be wholly and solely responsible and to be in compliance with all the Italian and European laws and the laws of the other countries on the subject of imports and exports.

Il seguente documento rappresenta i "Termini di utilizzo del servizio iShopps" che di seguito saranno indicati come “Termini del Servizio”. Essi regolano l’accesso e l’utilizzo del Servizio da parte degli Utenti, mediante l’accesso o l’utilizzo di "iShopps". Per favore ti invitiamo a leggere questo documento con attenzione, e a contattarci via e-mail all’indirizzo info@ishopps.com per qualsiasi dubbio o domanda. Accedendo e/o utilizzando i Servizi di iShopps, accetti i seguenti Termini del Servizio e la relativa Privacy Policy. I Termini del Servizio sono applicabili a tutti gli utenti, sia registrati che semplici utilizzatori. In nessun modo puoi utilizzare l’App senza aver riconosciuto e accettato i seguenti Termini del Servizio.

Quando decidi di usare iShopps dichiari di essere d’accordo con queste condizioni:

1. Per utilizzare l’applicazione iShopps è obbligatorio aver compiuto tredici anni di età.
2. La violazione di qualcuno di questi punti dell’accordo comporta una cancellazione del tuo account di iShopps. Raccomandiamo un utilizzo corretto dell’applicazione, ma in ogni caso non ci riteniamo in alcun modo responsabili per qualsiasi contenuto postato, ti rendiamo consapevole che se decidi di utilizzare iShopps lo fai a tuo rischio e pericolo, ivi compreso il rischio di essere esposto a Contenuto offensivo, indecente, impreciso, discutibile o diversamente inopportuno.
3. Attraverso l’utilizzo del Servizio iShopps, ti ricordiamo che non puoi in alcun modo violare qualsiasi legge applicabile nella Nazione di fruizione del Servizio.
4. È vietato postare nudità, totali o parziali, o fotografie sessualmente suggestive.
5. È vietato postare immagini o contenuti relativi alle seguenti categorie merceologiche: sexy shop, armi e munizioni, caccia e pesca, agenzie funebri, liquori e super alcolici, tabacco e sigarette, scommesse e lotterie, astrologi e cartomanti.
6. Non devi abusare, molestare, minacciare, impersonificare o intimidire gli altri utenti iShopps. Inoltre è vietato postare contenuti dannosi per il funzionamento del Servizio.
7. Non puoi usare il servizio di iShopps per ogni scopo illegale o non autorizzato. Gli utenti internazionali accettano di operare e pubblicare contenuti in accordo con i presenti Termini del Servizio. iShopps ti considera il solo e unico responsabile della tua condotta e qualsiasi informazione, testo, dato, nome di schermata, grafica, foto, profilo, contenuti audio e video, links, che posti o condividi sul servizio iShopps. Non ti è permesso modificare o compiere qualsiasi tipo di azione che possa compromettere il funzionamento del sito web e dell'applicazione iShopps. Inoltre è espressamente vietato utilizzare in modo improprio e/o non riconosciuto dai titolari del marchio iShopps il sito e/o il Servizio.
8. È vietato impersonare un altro individuo (p.e. adottare l'identità di una celebrità o di un retailer), creare o utilizzare un account al posto di un’altra persona, fornire un indirizzo e-mail diverso dal tuo o creare più account.
9. Sei responsabile per ogni attività compiuta a tuo nome, non è da sottintendersi che i tuoi contenuti siano in qualsivoglia modo sponsorizzato o sostenuto da iShopps.
10. Hai la responsabilità di tenere la tua password al sicuro.
11. Non è permesso inviare e-mail o messaggi, commenti indesiderati e considerati pubblicitari attraverso il Servizio (Spam).
12. Non ti è permesso di utilizzare il codice URL ed il sito web di iShopps a tuo nome.
13. È vietato postare immagini provenienti da negozi, brand-store e centri commerciali che non consentono la ripresa di immagini all’interno dei loro punti vendita. iShopps declina ogni responsabilità derivante dalla non osservanza di tali divieti.

I tuoi contenuti. iShopps ti permette di postare contenuti, commenti, ashtag, wish, like, foto e video sul Servizio. Qualsiasi contenuto tu condivida, mostri o in qualsiasi modo renda disponibile sul Servizio (indicati di seguito come "Contenuto Utente"), tu attribuisci a iShopps i diritti all'utilizzo e alla diffusione dei contenuti stessi.

Categorie merceologiche. iShopps consente di pubblicare le immagini dei prodotti commercializzati dai negozi fisici di tutto il mondo. Tuttavia esistono delle limitazioni relative alle classi merceologiche che possono essere rappresentate, inserite e documentate all'interno dell'applicazione. In particolare è vietato pubblicare immagini, contenuti, informazioni, promozioni e tutto quanto si riferisca, sia in forma diretta sia in forma allusiva, alle seguenti categorie merceologiche: sexy shop, armi e munizioni, caccia e pesca, agenzie funebri, liquori e super alcolici, tabacco e sigarette, scommesse e lotterie, astrologi e cartomanti. Gli account degli utenti e dei retailer che violeranno questa norma saranno senza preavviso cancellati dal data base a insindacabile giudizio di iShopps.

Divieti per scatti fotografici e riprese video. iShopps incoraggia e sostiene i negozi, i brand-store e i centri commerciali che favoriscono la possibilità di condividere, attraverso l’app, le immagini dei prodotti in vendita, nella convinzione che il miglior veicolo pubblicitario siano i clienti stessi i quali, attraverso la loro rete di contatti e amicizie, possono diffondere la conoscenza dei prodotti e delle offerte, accrescere l’audience e portare nei punti vendita un maggior numero di acquirenti. Tuttavia ci sono nel mondo numerosi negozi, brand-store e centri commerciali che non consentono la ripresa di immagini all’interno dei loro punti vendita, invitiamo pertanto gli utenti di iShopps a verificare l’esistenza di tale divieto prima di condividere immagini attraverso l’applicazione. iShopps declina ogni responsabilità derivante dalla non osservanza di tali divieti.

Limitazioni nella pubblicazione dei contenuti degli utenti privati. iShopps consente agli utenti di pubblicare immagini fotografiche e/o brevi video (max 15 sec.) classificandoli secondo tre categorie: "love", "gift", "bought ".

Nella categoria "love" è possibile inserire non solo i prodotti che si vorrebbero acquistare, ma anche quelli che semplicemente piacciono o che si ritengono interessanti per altre persone. Si possono anche mostrare le vie dello shopping, le vetrine più belle, le ambientazioni d'interni e i punti di vista originali dei negozi visitati, le insegne, i marchi, le confezioni e tutto quello che nell'ambito dello shopping è ritenuto appassionante e bello da condividere.

Nella categoria "gift" possono essere mostrati i prodotti acquistati (o che si vorrebbero acquistare) per fare un regalo. È sempre bello poter donare qualcosa a qualcuno, immaginare mentre si sceglie il regalo la gioia e la sorpresa della persona che riceverà il piccolo o grande dono pensato per lei. Ancora più bello e utile è poter condividere questi momenti con i propri amici ai quali magari chiedere consigli e suggerimenti quando si è indecisi nella scelta.

La categoria "bought" è dedicata ai prodotti acquistati. Impiegare del tempo per andare a curiosare tra i negozi, trovare qualcosa di speciale da regalarsi e decidere di acquistarla è sempre una piccola o grande soddisfazione personale. Condividere questo piacere con gli altri in tempo reale è ancora più gratificante perché qualsiasi gioia è più bella solo quando è condivisa.

Indipendentemente dalla categoria selezionata per ciascun oggetto l’utente ha la possibilità d’indicare: il prezzo di vendita, un breve commento, le tag (parole chiave che ne consentono la ricerca), il nome del negozio, la sua geolocalizzazione. L’utente può inoltre decidere di condividere l’oggetto sul proprio account Facebook o di non condividerlo utilizzando il pulsante “Pirvate Only” (icona del lucchetto). iShopps consente agli utenti privati di postare in modo illimitato immagini e contenuti all'interno dell'applicazione, tuttavia ogni tentativo di abuso e danneggiamento attraverso azioni di sovraccarichi di upload saranno bloccati e i relativi account potrebbero essere cancellati dal data base di iShopps senza alcun preavviso.

Punteggio utenti privati. Ogni volta che usi iShopps con un account da utente privato (non retailer) hai la possibilità di accumulare punti per raggiungere un nuovo livello di popolarità all'interno della community. Gli status utente in iShopps sono cinque:

“star” oltre 50.000 punti
“celebrity” da 20.000 a 49.999 punti
“expert” da 5.000 a 19.999 punti
“qualified” da 1.000 a 4.999 punti

Far crescere il tuo punteggio è la tua notorietà all'interno di iShopps è facile e divertente, ti basta condividere attraverso l'app le tue esperienze di shopping più piacevoli. Inoltre puoi migliorare il punteggio e lo status anche attraverso altre azioni (come ad esempio diventare "follower" di utenti e negozi) che ti consentiranno di ottenere diverse quantità di punti. Ecco la lista delle azioni con le quali potrai accrescere il tuo punteggio:

registrazione personale con email ID d'invito
registrazione retailer (quando un negoziante si registra con la tua email ID)

50 punti
registrazione personale
registrazione altro utente (quando un utente si registra con la tua email ID)

30 punti
aggiunta store (quando aggiungi il nome di un nuovo negozio)

20 punti
upload di un video
follower (essere seguito da un utente o da un retailer)

10 punti
upload di una foto
like su foto/video ricevuto da un altro utente
following (seguire un altro utente)
fan (diventare fan di un retailer)
love brands (aggiungere una marca alla propria lista)
invita un amico (quando invii un’email d’invito)

1 punto
like su foto/video di un altro utente

Una volta raggiunto il punteggio massimo predefinito per ciascuno status passerai automaticamente a quello successivo. Ad ogni passaggio di status nel tuo profilo utente si modificheranno visivamente l’icona dello status, la cornice della foto e l'immagine di sfondo. I tuoi dati saranno così presentati in un nuovo contesto visuale che metterà in evidenza il livello di esperienza raggiunto.

Con un po' d'impegno e molto divertimento potrai presto diventare una persona autorevole nella community di iShopps e guadagnare visibilità all'interno della sezione "popular".

Per mantenere o migliorare il tuo livello di popolarità devi però utilizzare l'app con una certa continuità. Se iShopps non viene utilizzato per più di trenta giorni i punti accumulati si perderanno gradualmente, questo può implicare anche un declassamento del livello di status raggiunto, fino a ritornare al livello iniziale di "beginner" con il punteggio assegnato al momento della registrazione.

Quindi ogni volta che fai shopping non lasciarti sfuggire l'occasione di condividere le cose belle che scopri per mantenere e accrescere il tuo livello di popolarità.

Attenzione! Ricorda che registrare utenti o retailer “finti” al solo scopo di accumulare punti comporterà l’automatica cancellazione dell’account senza alcun tipo di preavviso.

Limitazioni nella pubblicazione dei contenuti dei negozianti. iShopps consente ai retailer di pubblicare immagini fotografiche e/o brevi video (max 15 sec.) classificandoli secondo tre categorie: "store", "product", "on offer".

Nella categoria “store” è possibile inserire immagini o video del punto vendita (vetrine, ambienti interni, reparti commerciali, ecc.), a ciascuna immagine il retailer può abbinare un breve commento e le tag (parole chiave che ne consentono la ricerca).

Nella categoria “product” è possibile inserire immagini o video dei prodotti in vendita, a ciascuna immagine il retailer può abbinare un breve commento, il prezzo di vendita espresso nella valuta locale (selezionabile nell’area “settings”), le tag (parole chiave che ne consentono la ricerca).

Nella categoria “on offer” è possibile inserire immagini o video dei prodotti in offerta, a ciascuna immagine il retailer può abbinare un breve commento, il vecchio ed il nuovo prezzo di vendita espressi nella valuta locale (l’applicazione calcolerà in automatico la percentuale di sconto), la data di scadenza dell’offerta, le tag (parole chiave che ne consentono la ricerca).

Indipendentemente dalla categoria selezionata il retailer può inoltre decidere di condividere l’oggetto sul proprio account Facebook.

La pubblicazione delle immagini è attualmente consentita secondo le seguenti limitazioni numeriche:
- nella categoria "store" è possibile pubblicare fino ad un massimo di 9 (nove) immagini
- nella categoria "product" è possibile pubblicare fino ad un massimo di 18 (diciotto) immagini
- nella categoria "on offer" è possibile pubblicare fino ad un massimo di 9 (nove) immagini.

L'inserimento di nuove immagini rispetto a quelle già pubblicate richiede la cancellazione da parte del retailer delle immagini precedenti se queste hanno raggiunto il limite numerico predefinito.

Le immagini inserite in categoria "on offer" sono corredate da una data di scadenza dell'offerta determinata dal retailer in fase di upload, tale scadenza non potrà comunque essere superiore a 365 giorni. Una volta superata temporalmente la scadenza predefinita, sotto l'immagine comparirà, al posto della data, la dicitura " offer expired". L'immagine rimarrà comunque visibile agli utenti di iShopps fino a quando il retailer non deciderà di eliminarla.

Nelle prossime versioni dell'applicazione sarà possibile superare il limite del numero di immagini pubblicabili da ciascun retailer attraverso l'acquisizione di "credits" che consentiranno di gestire in modo autonomo campagna di comunicazione "pay per day".

Come iShopps e gli altri Utenti possono utilizzare i tuoi contenuti. Indipendentemente da qualsiasi impostazione del tuo account tu decida di utilizzare, rilasci ad iShopps licenza non esclusiva, libera da qualsiasi diritto e royalty, trasferibile e sublicenziabile, valida in tutto il mondo, per utilizzare, mostrare, riprodurre, ri-condividere, modificare (ri-formattare per esempio) e distribuire il tuo Contenuto Utente sul Servizio iShopps, o su altri di sua competenza, con lo scopo di operare e garantire il Servizio a te e agli altri utenti. Per favore, ricorda che il Servizio iShopps è una piattaforma pubblica, e che altri utenti possono ricercare, vedere, utilizzare, e/o condividere qualsiasi Contenuto Utente che tu decidi di rendere pubblico attraverso il Servizio.

Conservazione dei Contenuti Utente. Per qualsiasi chiusura del Servizio o disattivazioni del tuo Account, o se rimuovi qualsiasi contenuto utente dal tuo Account o dal Servizio, ti informiamo che iShopps si riserva il diritto di conservare i tuoi contenuti Utente per attività di back-up, archiviazione, o scopi di Audit. Ricorda che anche altri Utenti possono conservare e continuare a mostrare, riprodurre, ricondividere, modificare, ridisporre e distribuire qualsiasi tuo Contenuto Utente che altri Utenti hanno condiviso attraverso il proprio Account o che tu hai postato ad altri Utenti. Anche se l’utente viene segnato come "non attivo", tutti i dati che egli ha caricato rimarranno disponibili nei nostri archivi, grazie a questa scelta un Utente avrà sempre la possibilità di "tornare sui suoi passi" facendosi riattivare l'account. Se qualcuno ricerca il profilo di un utente "non attivo", un semplice messaggio avviserà che l'utente non è presente sul data base (e quindi i dati non saranno visualizzati). Nei commenti, il suo nome non verrà più visualizzato.

Le tue responsabilità riguardo il Contenuto Utente. iShopps nasce con l’obiettivo di creare una comunità creativa e positiva per permetterti di scoprire e condividere le tue esperienze di shopping se sei un utente, oppure far conoscere i tuoi prodotti e le tue offerte se sei un retailer.

Ricorda che puoi essere legalmente perseguibile se, per esempio, il tuo contenuto contiene materiale falso, intezionalmente fuorviante o diffamatorio, se viola qualsivoglia diritto di terze parti, anche copyright, marchio, brevetto, segreto commerciale, diritto morale, diritto di privacy, diritto di pubblicità o qualsivoglia altro diritto di proprietà intellettuale o proprietario, se illustra materiale illecito, ivi compresi discorsi illeciti di incitamento all'odio o pornografia, se sfrutta o in altro modo danneggia i minori, oppure se viola, o incita alla violazione di, qualsivoglia legge o regolamento.

Il Contenuto dell'utente non necessariamente riflette l'opinione di iShopps. Noi ci riserviamo il diritto, ma non l’obbligo, di rimuovere il Contenuto Utente che giudichiamo possa violare i Termini del Servizio per qualsiasi ragione. Quindi per favore, per continuare a divertirti utilizzando la nostra fantastica App, usala nel modo più appropriato possibile e rispetta gli altri Utenti. Rimuoveremo i contenuti dell’Utente, se ci verrà espressamente richiesto dall'interessato via email info@ishopps.com.

Per le Terze Parti. iShopps rispetta I diritti di Terze Parti, creatori e proprietari di contenuti, e vi chiediamo di fare lo stesso. Tu inoltre accetti che qualsiasi Contenuto Utente che condividi o posti sul Servizio non viola e non violerà nessuna legge o infrangerà i diritti di qualsiasi terza parte, includendo senza limitazione qualsiasi diritto di proprietà intellettuale (definita di seguito), di pubblicità o diritto di privacy. Per iShopps è fondamentale che tu comprenda che sei nella migliore posizione possibile per sapere con certezza se è possibile condividere il tuo Contenuto Utente. Ti chiediamo inoltre di essere cauto nel decidere di rendere pubblico il tuo Contenuto Utente sul Servizio. Definizione di Diritto di Proprietà Intellettuale. Quando ci riferiamo a diritto di proprietà intellettuale in questi Termini del Servizio, ci riferiamo a qualsiasi diritto di brevetto, diritto di copyright, diritto morale, diritto di pubblicità, marchio registrato, marchio commerciale, marchio di servizi (e beni associati); marchi commerciali segreti, e qualsiasi altra proprietà intellettuale che esiste tutt’ora o che esisterà in futuro regolamentati dalle leggi di qualsiasi Stato, Paese, Territorio o Giurisdizione.

I Feedback che ci fornisci. iShopps è interessata agli Utenti, e a scoprire in che modo possiamo migliorare la fruibilità dei Servizi. Ti invitiamo quindi a condividere le tue idee, i tuoi suggerimenti e consigli. Ti ricordiamo però che qualsiasi materiale riceveremo dagli Utenti non sarà in alcun modo remunerato da iShopps. iShopps si impegna a non riconoscere alcuna forma di compensazione o riconoscimento agli utenti per il materiale sopracitato ricevuto. Gli utenti sono a conoscenza del fatto che qualsiasi suggerimento, consiglio, informazione e/o contenuto inviato ad iShopps potrà essere utilizzato da iShopps in modo libero, a sola discrezione di iShopps.

Proprietà dei contenuti di iShopps. Ad eccezione del Contenuto Utente pubblicati sul Servizio, tutti i contenuti e altro materiale presente su o nel Servizio, e tutti i diritti di proprietà intellettuale presenti nel o in relazione al Servizio o qualsiasi altra forma di contenuto, sono proprietà esclusiva di iShopps e dei suoi licenziatari, ivi inclusi, in via non esaustiva, le interfacce visive, le funzioni interattive, la grafica, il design, la compilazione, il codice dell’applicazione, i prodotti, il software, le classifiche di recensione aggregate degli utenti e tutti gli altri elementi e componenti dell’applicazione e del sito internet, escluso il contenuto dell'utente e il contenuto di terze parti. Siamo altresì proprietari dei copyright, dei marchi commerciali, dei marchi di servizio e di altri diritti intellettuali e di proprietà in tutto il mondo associati ad iShopps, che sono protetti dalle leggi in materia di copyright, trade dress, brevetti, marchi commerciali, e tutti gli altri diritti e leggi applicabili intellettuali e proprietari. In tal senso, è vietato modificare, riprodurre, distribuire, creare opere derivative o adattamenti, mostrare pubblicamente o in altro modo sfruttare interamente o parzialmente qualsivoglia Contenuto di iShopps, salvo laddove da noi espressamente autorizzato. Ad eccezione di quanto espressamente regolato da questi Termini del Servizio, tu accetti di non usare, modificare, riprodurre, distribuire, vendere, dare licenza, o sfruttare in alcun modo i contenuti di iShopps senza la nostra autorizzazione.

La nostra licenza per te. Soggetta ai Termini del Servizio e alle condizioni dei Termini del Servizio e della nostra Privacy Policy, ti garantiamo una licenza per utilizzare il Servizio, inclusa la possibilità di avere accesso e visualizzare il contenuto di iShopps, per i tuoi scopi personali e non commerciali, per potere condividere ciò che ti piace, ciò che pensi e il tuo shopping in generale. iShopps si riserva il diritto di poter terminare questa licenza in qualsiasi momento, per qualsiasi motivo o anche in assenza di particolari motivi. Ad eccezione di questa garanzia, tutti gli altri diritti sono di proprietà esclusiva di iShopps e nessun altro diritto può essere riservato agli utenti attraverso altre licenze.

Gli Utenti che possono utilizzare il Servizio. Puoi utilizzare il Servizio se e solo se sei in grado di stipulare un contratto con iShopps e solo in accordo con quanto previsto dai Termini del Servizio e applicabile dalle leggi, regolamenti e regole locali, statali, nazionali e internazionali. Qualsiasi accesso o utilizzo del Servizio di qualcuno che non abbia compiuto 13 anni è severamente proibito. Dato che noi rispettiamo la comunità di iShopps, il Servizio non sarà disponibile per coloro i quali sono esclusi dall’utilizzo del Servizio.

Gli Account di iShopps. Creare un Account con iShopps ti concede la possibilità di avere accesso al Servizio a nostra sola ed unica discrezione. Possiamo conservare diversi tipi di Account per diversi tipi di Utenti (Utenti privati, negozi e brand). Se decidi di aprire un Account, registrandoti per conto di un’azienda, organizzazione, o qualsiasi altro tipo di entità, allora per “tu” sarà indicata la tua persona e l’entità che rappresenti e tu garantisci di essere un rappresentante autorizzato di quella entità con l’autorità di legare l’entità che rappresenti ai Termini del Servizio, e che accetti i seguenti Termini del Servizio in nome dell’entità. Collegando iShopps ad un servizio terza parte (per esempio Facebook), autorizzi iShopps ad avere accesso ed utilizzare le tue informazioni da quel servizio come permesso da quel servizio e di conservare le tue credenziali per l’accesso a quel servizio. Per maggiori informazioni sul tipo di informazioni che reperiamo dai servizi di terze parti, ti invitiamo a leggere la nostra Privacy Policy. Tu accetti di non usare nomi utenti che siano offensivi, osceni, o molesti nei confronti degli altri utenti. iShopps si riserva il Diritto di richiedere di cambiare il nome utente in qualsiasi momento e per qualsiasi ragione, oppure per nessuna ragione, a sola e unica discrezione di iShopps.

Terminare il tuo account. Hai la possibilità di terminare il tuo account in qualsiasi momento, inviando un e-mail a info@ishopps.com. iShopps può permanentemente o temporaneamente terminare o sospendere il tuo Account Utente o accesso al Servizio per qualsiasi motivo, senza necessaria notifica o informazione nei tuoi confronti, incluso se a nostra sola e unica discrezione tu abbia violato qualsiasi Termine del Servizio previsto dai Termini del Servizio o dalla Privacy Policy oppure per nessuna ragione. Nonostante la cancellazione del tuo account, tu continui ad essere legato ai seguenti Termini del Servizio, per tutte le sezioni descritte all’interno dei Termini del Servizio relative all’utilizzo e conservazione dei contenuti utente, ai feedback che ci hai fornito, definizione di proprietà intellettuale, i contenuti di iShopps, le copyright policy, la chiusura dell'account, l'interazione con altri utenti.

La tua responsabilità per il tuo Account. Quando crei il tuo account iShopps sei obbligato a fornire con precisione e completezza le informazioni. Per favore assicurati di fornirci dati aggiornati, in modo da sapere come poterti contattare. iShopps consiglia ai propri utenti di utilizzare password difficili da riprodurre, combinando più elementi di lettere maiuscole, minuscule e numeri per il tuo account. Ti ricordiamo che sei il solo e unico responsabile per tutto quello che succede attraverso il tuo account, e che accetti di tenere il tuo account, login e password al sicuro. Per favore, informa iShopps per qualsiasi violazione avvenga alla sicurezza del tuo profilo.

Modifiche al servizio. iShopps si riserva il diritto e ha la facoltà di modificare le impostazioni, eseguire modifiche, cambiamenti al Servizio senza l’obbligo di inviare notifiche o relative informazioni agli Utenti. Vi invitiamo dunque a controllare periodicamente i Termini di utilizzo, per essere sempre al corrente delle modifiche eseguite.

I rapporti con gli altri Utenti. Per favore tieni presente che sei il solo responsabile per le tue interazioni con gli altri utenti. Il servizio può contenere Contenuti come collegamenti a siti web di terze parti, pubblicitari, Servizi, offerte speciali, o altri eventi e attività che non sono proprietà di iShopps oppure controllate da iShopps. iShopps non può in alcun modo essere ritenuta responsabile per qualsiasi contenuto relativo a terze parti quali: siti, informazioni, materiali, prodotti o Servizi. Inoltre iShopps non è in alcun modo responsabile per qualsiasi contenuto, attività, informazione, prodotto, materiale promozionale, pubblicato dagli utenti che in qualsiasi modo possa recare danno ad altri. Se accedi ad un contenuto, sito, link, o qualsiasi altra forma di collegamento a terze parti lo fai a tuo rischio e pericolo, e automaticamente accetti che iShopps non sia responsabile ad alcun titolo per qualsiasi conseguenza possa derivare da suddetti collegamenti a terze parti.

Aggiornamenti di iShopps. Il nostro obiettivo è quello di costruire una App dedicata a rendere unica la vostra esperienza di shopping attraverso il vostro iPhone. iShopps ti garantisce una licenza non esclusiva, non trasferibile, revocabile in qualsiasi momento, per qualsiasi motivo o per nessun motivo per utilizzare l’App dal tuo cellulare. È severamente vietato modificare, disassemblare, decompilare, o reingegnerizzare l’App, affittare, prestare, ricevere in prestito, rivendere, sub licenziare, distribuire o comunque trasferire l’App a qualsiasi terza parte o in ogni caso utilizzare l’App per fornire time sharing o servizi di questa natura a qualsiasi terza parte; fare copie dell’App, rimuovere, disabilitare o danneggiare, modificare o in ogni modo interferire con caratteristiche legate alla sicurezza dell’App, caratteristiche che prevengono o restringono l’utilizzo o la copiatura di qualsiasi contenuto accessibile attraverso l’App, o caratteristiche che rafforzano limitazioni sull’uso dell’App; o cancellare i copyright e i diritti degli altri proprietari sull’App. Sei a conoscenza che iShopps può, da un momento all’altro, rilasciare versioni aggiornate, può automaticamente aggiornare la versione dell’App che stai usando sul tuo dispositivo mobile. Tu consenti a tale aggiornamento tramite il tuo dispositivo, e accetti che i Termini del Servizio e la relativa Privacy Policy sia applicata a tale aggiornamento. Qualsiasi codice di terze parti che può essere incluso e incorporato nell’aggiornamento all’App, è coperto dall’applicabilità open source, oppure dalla licenza di utilizzo della terza parte, se c’è, che autorizza l’utilizzo di tale codice. La seguente licenza non rappresenta una vendita dell’App o qualsiasi tipo di copia, e iShopps mantiene (o in alternativa qualsiasi terza parte licenziataria o fornitrice) il pieno diriitto, titolo e interesse in e per l’App ( e ogni sua copia). Tu accetti di essere in accordo con tutte le leggi Europee e mondiali correlate all’utilizzo di App e dei servizi mobili.

Costi. L’App è venduta gratuitamente sull’Apple Store, e all’utilizzo si applicheranno i costi legati all’operatore telefonico.

Apple. Nonostante l’App sia in vendita sull’Apple Store, tu accetti e riconosci che Apple non è in alcun modo e non può essere in alcun modo ritenuta responsabile per qualsiasi azione intercorra tra te e iShopps.

Indennità. Tu accetti e sei a conoscenza di doverti astenere nei confronti di iShopps e i suoi dirigenti, direttori, impiegati, agenti e collaboratori da qualsiasi forma di richiesta, accusa, denuncia, procedimento giudiziario, disputa, responsabilità, danno, perdita, costo e spesa, inclusi e senza limitazioni, qualsiasi ragionevole spesa legale e spesa giudiziaria (inclusi costi di difesa da denuncia, processo o procedimento a carico di terze parti), sollevata da qualcuno in qualsiasi modo collegato al tuo accesso al Servizio o ai contenuti di iShopps, al tuo contenuto utente o qualsiasi tua infrazione a uno qualsiasi dei Termini del Servizio.

Disclaimer. Il Servizio, includendo senza limitazione di ogni sorta tutti i contenuti inclusi all’interno dell'applicazione sono forniti “così come sono” e come ”disponibili”, senza garanzia di sorta, anche se espressa o implicita. Anche per il futuro iShopps nega specificatamente qualsiasi garanzia sull'affidabilità del servizio. iShopps non si assume alcuna responsabilità, per qualsiasi contenuto utente che tu o qualche altro utente o terza parte pubblichi o invii sul Servizio. Tu sei il solito e unico responsabile per il tuo Contenuto utente e delle conseguenze che derivano dai tuoi post, o dal tuo materiale condiviso e pubblicato. Accetti inoltre che noi siamo solo agenti passivi nella distribuzione on-line del tuo contenuto e di quello degli altri utenti sul e attraverso il Servizio. Sei consapevole e accetti che potresti essere esposto a materiali che potrebbe risultare offensivi, nocivi, dannosi, disturbanti e violenti, o che possano in qualsiasi modo risultare non graditi o non corretti, tendenziosi, discutibili, falsi, inappropriati per i bambini e sconvenienti per l’utilizzo.

Tu accetti che né iShopps o qualsiasi altra parte di qualsiasi natura, coinvolta nell’ideazione, creazione o consegna del Servizio può essere in alcun modo ritenuta responsabile per qualsiasi danno consequenziale incidentale, speciali, esemplare, punitivo, inclusi la perdita di profitti, la perdita di informazioni, perdita di beni, interruzioni di servizio, danno al computer o interruzione del sistema o per il costo di prodotti sostitutivi o Servizi, derivanti da tali Termini o dal Servizio, o dall’utilizzo o dalla non possibilità di utilizzare i Servizi, il contenuto utente, il contenuto di iShopps, o da qualsiasi comunicazione, interazione, o incontro reale concreto o virtuale, con altri utenti e non, o con persone con le quali hai interagito attraverso il sistema del Servizio, o come risultato del’utilizzo del servizio. iShopps non è responsabile in alcun modo delle possibili problematiche che possano sorgere nei confronti di utenti e retailer in relazione agli sviluppi dell’utilizzo di tali Servizi. La limitazione della responsabilità di cui sopra è un elemento fondamentale alla base dell’accordo tra te e iShopps. Alcune giurisdizioni non permettono l’esclusione di certe garanzie o l’esclusione o la limitazione della responsabilità per danni consequenziali o incidentali, quindi il sopra citato disclaimer, e le limitazioni potrebbero non essere applicabili nello specifico.

In qualsiasi caso, la cifra massima rimborsabile da iShopps per qualsiasi sorta di penalità risultante da qualsiasi differente giurisdizione non potrà superare per nessuna ragione la cifra di 100 euro (cento euro).
Il Servizio è controllato e opera dalle sue strutture in Italia. iShopps non garantisce e non si assume la responsabilità di dichiarare il suo prodotto fruibile in altri Paesi. Coloro i quali accedono o utilizzano il Servizio da giurisdizioni differenti da quella italiana, lo fanno a loro sola e unica responsabilità e volontà, e sono interamente responsabili, soli e unici, per la conformità alle leggi, statuti, regolamentazioni, leggi regionali, statali, federali, costituzioni, direttive, e qualsiasi altra interpretazione di Diritto governativo, amministrativo, o corte competente, includendo, ma non limitando a tali ordinamenti legati alla materia di import o export di software, informazioni tecniche e Servizi. Potresti non usare il Servizio se ti trovi in un Paese che subisca l’embargo dall’Europa, o se sei una persona straniera o entità bloccata o non gradita dall’Europa.

Arbitrato e leggi governative. Per qualsiasi disputa in corso con iShopps, tu accetti di contattare prima iShopps tramite l’indirizzo e-mail info@ishopps.com e tentare di risolvere la disputa in modo informale. Nell’indesiderata eventualità in cui iShopps non sia in grado di risolvere la disputa in corso nei tuoi confronti in modo informale, accettiamo di risolvere la disputa, richiesta, citazione correlata o derivante dall’utilizzo del Servizio, o in relazione ai seguenti Termini del Servizio, o violazioni o presunte infrazioni, attraverso il foro competente di Torino (Italia), riconosciuto come solo e unico competente per risolvere in modo formale questo tipo di dispute. Accettando questi Termini del Servizio, tu e iShopps rinunciate alla possibilità di partecipare a class action. Tu accetti inoltre che il servizio può essere giudicato solo ed unicamente in Italia, e eventuali contestazioni si considerano nulle, cioè che non danno luogo ad azioni giuridiche, specifiche o generali, in giurisdizioni diverse da quella di Torino (Italia). Le presenti Condizioni sono disciplinate dalle leggi italiane, senza tenere conto del conflitto di principi di legge. L'applicazione della Convenzione delle Nazioni Unite sui contratti di vendita internazionale di merci è espressamente esclusa. Ciascuna delle parti accetta di sottoporsi alla giurisdizione del tribunale di Torino (Italia), per eventuali azioni per le quali una delle parti si riserva il diritto di chiedere ingiuntiva o altra riparazione equa, come ulteriormente descritto nei precedenti articoli.

Procedure di notifica e cambiamenti del Servizio. iShopps può fornire notifiche, sia se tali notifiche sono richieste dalla legge, oppure se sono per scopi di marketing o per scopi di qualsiasi altro tipo, inviandoti notifiche via e-mail “push” o notifiche via dispositivo mobile, o postando tali notifiche sul sito web, come deciso da iShopps e a sola e unica discrezione di iShopps. iShopps si riserva il diritto di decidere la forma, i tempi e i contenuti nel fornirti le notifiche, considerando che tu puoi anche decider di non ricevere tali notifiche. In seguito all’accesso e all’utilizzo del Servizio, rinunci ad avanzare qualsiasi richiesta relativa alla non ricezione di notifiche. iShopps può decidere in qualsiasi momento, per qualsiasi ragione, o per nessuna ragione, di cambiare il testo del seguente documento o di qualsiasi altro documento relativo alle condizioni del Servizio. Ti consigliamo quindi di rivedere periodicamente le pagine relative ai Termini del Servizio.

Assegnazione. Questi Termini del Servizio e qualsiasi diritto o licenza concessi di seguito, non possono essere trasferiti né assegnati da voi, ma possono essere assegnati da iShopps senza limiti di sorta. Qualsiasi tentativo di trasferimento o assegnazione in violazione sarà considerato nullo e non valido.

Controllo dell’esportazione. Qualsiasi software o tecnologia ottenuta da iShopps attraverso il Servizio, inclusa l’App, ha origine in Italia, ed è soggetta alle legge italiane relative alla regolamentazione delle esportazioni. Questo tipo di software e tecnologia potrebbe non essere esportata o ri-esportata in alcuni paesi o utilizzata da persone a cui è proibito ricevere materiale esportato proveniente dall’Italia. Inoltre, software e tecnologie ottenute attraverso iShopps possono essere soggette alle leggi di import ed export di altri paesi. Attraverso l'utilizzo dell'applicazione tu accetti di essere il solo e unico responsabile e di essere conforme a tutte le leggi Italiane, Europee e degli altri Paesi del mondo in materia di importazione ed esportazione.

Accordi tra te e iShopps. Questi Termini del Servizio, insieme ad ogni emendamento e addizionale accordo che può essere inserito da iShopps in relazione al Servizio, costituisce l’intero accordo tra te e iShopps per quanto riguarda il Servizio. Se qualcuno dei punti del seguenti Termini del Servizio venisse giudicato invalido da un Tribunale o Giurisdizione competente, l’invalidità di tale punto non potrà in nessun modo intaccare la validità dei restanti punti del Servizio, che rimangono in vigore a tutti gli effetti.

Rinuncia. I seguenti Termini del Servizio non possono essere non accettati da te al momento dell’utilizzo dell’App. tu non puoi rinunciare a nessuno dei Termini del Servizio, per qualsiasi motivo o per nessun motivo. Inoltre ti impegni a rinunciare a qualsiasi tentativo di partecipare a attività attraverso class action.
